Welcome to What's This, operated by Deseur, LLC ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of the What's This mobile application ("App"). By creating an account and using the App, you agree to be bound by these Terms and Conditions.

Eligibility

You must be at least 18 years old to use this App. By registering, you represent and warrant that you meet this age requirement.

Account Registration

To use the App, you must register for an account. You agree to provide accurate and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Subscription and Fees

Access to the App is subscription-based. Subscription fees and billing terms are provided within the App and are subject to change with prior notice. All fees are non-refundable unless otherwise stated.

User Content

Users may submit reviews, comments, and suggestions ("User Content") related to Points of Interest (POIs). By submitting User Content, you grant Deseur, LLC a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and display such content in connection with the App.

You agree not to post User Content that is:

• False, misleading, or inaccurate.
• Defamatory, obscene, or abusive.
• Infringing on intellectual property rights.
• In violation of any law or regulation.

We reserve the right to remove or modify any User Content at our sole discretion.

Third-Party Services

The App integrates with third-party services such as OpenFreeMap. Your use of these services is subject to their own terms and conditions. Deseur, LLC is not responsible for the content or services provided by third parties.

Data Collection and Privacy

We do not collect or store your precise location. However, we may collect data on which POIs you interact with for performance analytics and content improvement. Please review our [Privacy Policy] for more details.

Intellectual Property

All content within the App, including but not limited to software, design, graphics, and trademarks, is owned by or licensed to Deseur, LLC. You may not copy, reproduce, or distribute any part of the App without our prior written consent.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. Deseur, LLC disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy or completeness of any POI data.

Limitation of Liability

To the maximum extent permitted by law, Deseur, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the App.

Termination

We may suspend or terminate your account and access to the App at any time, without notice, if you violate these Terms or engage in unlawful conduct.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting in the App. Your continued use after changes constitutes acceptance.

Arbitration and Dispute Resolution

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your relationship with Deseur, LLC shall be resolved through final and binding arbitration administered by a neutral arbitrator, and not in a court of law. This includes any claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.

The arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA), and shall take place in Florida, United States of America, unless otherwise agreed by both parties. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

You understand and agree that, by accepting these Terms, both you and Deseur, LLC are waiving the right to a trial by jury or to participate in a class action.

However, either party may bring a claim in small claims court if it qualifies. This arbitration agreement does not prevent either party from seeking injunctive or equitable relief in a court of law for matters related to intellectual property or unauthorized access to the App.
